Among other recent Medicaid reforms, the 2015 Texas Legislature responded to physicians call for due process improvements in overzealous fraud investigations by the office of Inspector General (OIG).

Senate Bill 207 signed into law on June 18, 2015 clarifies that fraud does not include unintentional technical, clerical, or administrative errors;

It requires probable cause of a credible allegation of fraud for payment holds;

It requires the OIG to give physicians a detailed summary of its evidence relating to the allegation;

It gives the OIG 180 days to complete an investigation:

and it gives physicians 10 days to request a confidential, informal settlement meeting
